In 1999, Barton Beebe critiqued a “golden age” of space law in the 1950s and 1960s in which obscure legal issues concerning space exploration and aliens were addressed. This article describes a more recent “golden age” in legal scholarship, namely that relating to virtual worlds such as World of Warcraft and Second Life. The author examines the motivations of legal scholars who write about legal issues at this new technological frontier. This article identifies the types of legal issues that result from technological change and discusses the different institutions involved in resolving those problems. It demonstrates that, despite the focus on political solutions, other institutions also have a role to play in solving legal dilemmas presented by technological change. Legislation may not always be necessary and can cause problems, especially where a technology is likely to evolve further. Datafication of social life affects what society regards as knowledge. Jasanoff’s regimes of sight framework provides three ideal-type models of authorised knowing in environmental data practice. This paper applies Jasanoff's framework for analysing intelligence practice through an exploratory empirical study of crime and intelligence practitioners in a selection of police services in Australia, New Zealand, Canada and the United States. The paper argues that the ‘view from somewhere’ captures the essence of existing police intelligence practices in the four countries but (...) the ‘view from nowhere’ is emerging as a possible future for police intelligence – an approach promoted by technology companies and supported mainly by police leaders and managers. The paper investigates the challenges and limits of a shift by police from VFS to VFN in the production of intelligence; the challenges are primarily political, which threaten the dominance of police contextual knowledge over ‘scientific’ knowledge. These political challenges also have symbolic and material implications. The paper concludes that, because of these challenges, a complete shift from VFS to VFN is not likely to happen. At best the two models might co-exist with the latter subordinate to the imperatives of the former, resulting in further tension between sworn officers and civilians, organisational inertia, as well as technologies that may be under-utilised or abandoned. In this essay, I draw out some implications of a position called “Wittgensteinian Quasi-Fideism” for the theory and practice of interreligious communication. After setting out the main tenets of that position, I articulate what its theoretical and practical implications in this area would be if it were true. I thereby sketch a new, Wittgensteinian model of interreligious communication, concluding with a number of suggestions as to some points of focus for further work in this area.

In this paper I consider whether traditional behaviors of animals, like traditions of humans, are transmitted by imitation learning. Review of the literature on problem solving by captive primates, and detailed consideration of two widely cited instances of purported learning by imitation and of culture in free-living primates (sweet-potato washing by Japanese macaques and termite fishing by chimpanzees), suggests that nonhuman primates do not learn to solve problems by imitation. It may, therefore, be misleading to treat animal traditions and human (...) culture as homologous (rather than analogous) and to refer to animal traditions as cultural. (shrink)

Written in the 12th century in Arabic by a faithful Jewish man, "The Guide" is a work that explores the contradiction a very intelligent mind clearly saw between the tradition he was raised to believe inherently and the growing philosophy of Arabian and Western culture. In Maimonides' time, there was an emerging disparity between the Law and a new level of philosophical sophistication, which he attempts to bridge in this work, primarily through the use of metaphor, though also acknowledging this (...) method's limitations. "The Guide" follows the form of a three-volume letter to a student, which was quickly translated to Hebrew and spread throughout the known world and carefully read by Jews and non-Jewish philosophers alike well through the Middle Ages. How can we motivate ourselves to do what we think we ought? How can we deliberate about personal values and priorities? Bennett Helm argues that standard philosophical answers to these questions presuppose a sharp distinction between cognition and conation that undermines an adequate understanding of values and their connection to motivation and deliberation. Recently there has been a resurgence of philosophical interest in love, resulting in a wide variety of accounts. Central to most accounts of love is the notion of caring about your beloved for his sake. Yet such a notion needs to be carefully articulated in the context of providing an account of love, for it is clear that the kind of caring involved in love must be carefully distinguished from impersonal modes of concern for particular others for their sakes, such (...) as moral concern or concern grounded in compassion. There is now a general consensus amongst philosophers in the values in science literature that values necessarily play a role in core areas of scientific inquiry. We argue that attention should now be turned from debating the value-free ideal to delineating legitimate from illegitimate influences of values in science, a project we dub “The New Demarcation Problem.” First, we review past attempts to demarcate the uses of values and propose a categorization of the strategies by where they seek to draw (...) legitimacy from. Next, we propose a set of desiderata for what we take to be a satisfactory solution and present a case study where conflicting sets of values clearly impinge on science, but where the legitimacy of their influence is ambiguous. We use these desiderata and the case study to illustrate what we take to be the strengths and weaknesses of current strategies. To be clear, our goal is not to answer the question we pose, but to articulate a framework within which a solution can be judged. (shrink)

The current study highlights Ghanaian universities’ heads of department’s ethical principles and the influence on the attainment of departmental goals. Two reputable universities were selected as the focal of the study. The purpose of the study was to motivate ethical leadership practices as essential ingredients for the attainment of departmental goals. The empirical data set was generated through a number of individual face-to-face interviews with thirty heads of departments in two universities in Ghana to explore their ethical practice. Thematic analysis (...) was used for the data analysis. It was found among others that ethical principles influence departmental goal attainment. The conclusion drawn from the findings brought to fore that leadership ethics was central to leaders’ goal attainment thus ought to be enforced. The current study is useful for educational researchers and policymakers, educationists and educational leaders such as heads of departments, dean of faculties/schools, lecturers and other stakeholders interested in educational leadership ethics. The paper can also inform policy on leadership studies and development and help design best practices of leadership in universities. It is recommended that educational leaders be mindful of ethical values since they influence the attainment of their goals. There is a novel leadership ethics and goal attainment framework developed by the researcher that speaks volumes regarding the subject-matter. Through postcolonial studies, indigenous perspectives are finally being heard, challenging various Western views of the world. However, these challenges are often made in the same moralizing voice as the original conlonizations were justified. In keeping with the moralizing-resistant perspectives of Foucault, Benjamin and Derrida The Politics of Moralizing issues a warning about the risks of speaking, writing and thinking in a manner too confident about you own judgments. Can a clear line be drawn between dogmatism and simple certainty and indignation? (...) This collection starts by questioning what has become a popular, even pervasive, cultural narrative told by both the left and the right-the story of the West's moral decline, degeneration or confusion. Beyond declaiming the perils of this approach, each essay goes on to experiment with strategies for warding off moralistic tendencies and effects within our own texts and actions. Contributors even explore the dynamics and dilemmas of moralizing by advocates of liberal causes, including patriotism, environmental protection and women's rights. The Politics of Moralizing argues that taking the so-called moral high ground gives free license to self-aggrandizement, cruelty, vengeance and punitiveness and a generalized resistance to or abjection of diversity. Corporations are increasingly asked to specify a ‘purpose.’ Instead of focusing on profits, a company should adopt a substantive purpose for the good of society. This chapter analyses, historicises, and radicalises this call for purpose. It schematises the history of the corporation into two main purpose/power regimes, each combining a way of thinking about corporate purpose with specific institutions to hold corporate power to account. Under the special charter regime of the seventeenth to mid-nineteenth centuries, governments chartered companies to pursue (...) specific public purposes. Under criticism for corruption and lack of competition, the special charter regime gave way to the contemporary general incorporation regime, under which no particular purposes are demanded of corporations, and profit-seeking has become the norm. This regime has now come under criticism, with calls for a new social purpose regime. The analysis of these three regimes focuses on politicisation. The chapter argues that orienting companies to substantive social purposes requires politicising the business corporation, creating meaningful accountability mechanisms to align companies with the goals of the public. The purpose paradigm must overcome its political timorousness and be more institutionally radical. The difficulty is doing this without unacceptable corruption and inefficiency. A form of ‘proper politicisation’ is needed. At the end of the chapter, some directions for reform are discussed, which may deliver on that desideratum. (shrink)

Abstract:This article brings together considerations from philosophical work on standpoint epistemology, feminist philosophy of science, and epistemic injustice to examine a particular problem facing contemporary psychiatry: the conflict between the conceptual resources of psychiatric medicine and alternative conceptualizations like those of the neurodiversity movement and psychiatric abolitionism. I argue that resistance to fully considering such alternative conceptualizations in processes such as the revision of the Diagnostic and Statistical Manual of Mental Disorders emerges in part from a particular form of epistemic (...) injustice (hermeneutical ignorance) leveled against a particular social group (which I call the "psychopathologized"). Further, insofar as the objectivity which psychiatry should aspire to is a kind of "social objectivity" which requires incorporation of various normative perspectives, this particular form of epistemic injustice threatens to undermine its scientific objectivity. Although many questions regarding implementation remain, this implies that psychiatry must grapple substantively with radical reconceptualizations of its domain if it is to achieve legitimate scientific objectivity. One often hears it said that our visual-perceptual contact with the world is “perspectival.” But this can mean quite different things. Three different senses in which our visual contact with the world is “perspectival” are distinguished. The first involves the detection or representation of behaviorally important relations, holding between a perceiving subject and the world. These include time to contact, body-scaled size, egocentric position, and direction of heading. The second perspective becomes at least explicitly manifest in taking up the “proximal (...) mode” and involves the representation of relational “appearance properties,” such as, perhaps , angular size and angular/projective shape at or from a viewpoint. The third perspective is associated with the pencil of rays structured by the position and geometry of the eyes. The relationships between these three perspectives are charted, and their connection with conscious experiential awareness discussed. So, e.g., there is no simple or direct route from the detection of the relations constitutive of perspective2 to detection of the relations constitutive of perspective1. The relations definitive of perspective3 are probably not themselves detected or represented by the visual system, but define the informational arena within which detection of the relations definitive of perspective1 and perspective2 takes place. Among medical researchers and clinicians the dominant view is that it is unethical to deceive patients by prescribing a placebo. This opinion is formalized in a recent policy issued by the American Medical Association (AMA [Chicago, IL]). Although placebos can be shown to be always safe, often effective, and sometimes necessary, doctors are now effectively prohibited from using them in clinical practice. I argue that the deceptive administration of placebos is not subject to the same moral objections that face other (...) forms of deception in clinical practice and medical research. Although deception is normally objectionable on the grounds that it limits autonomy and breaches trust, these grounds do not apply to placebos when they are prescribed within appropriate ethical limits. Patients have reason to prefer that doctors can prescribe placebos in ethically responsible ways. Hence, the AMA has an obligation to endorse and to promote the responsible use of deceptive placebos in clinical practice. (shrink)

Descartes rightly attacked the idea of space as extended nothing, but in inferring that space is an extended something, a substance, he overlooked the possibility that it is instead a system of relations. Even if it is a substance, it does not follow – as Descartes implied that it does – that “space” and “matter” are synonymous. It might instead be that space is a substantial container, portions of which can be colocated with bodies or that space is a substantial (...) separator, portions of which flow into all locations where there are no bodies. Industry is a major source of funding for scientific research. There is also a growing concern for how it corrupts researchers faced with conflicts of interest. As such, the debate has focused on whether researchers have maintained their integrity. In this article we draw on both the history of medicine and formal modeling to argue that given methodological diversity and a merit-based system, industry funding can bias a community without corrupting any particular individual. The phenomenology of emotions has traditionally been understood in terms of bodily sensations they involve. This is a mistake. We should instead understand their phenomenology in terms of their distinctively evaluative intentionality. Emotions are essentially affective modes of response to the ways our circumstances come to matter to us, and so they are ways of being pleased or pained by those circumstances. Making sense of the intentionality and phenomenology of emotions in this way requires rejecting traditional understandings of intentionality and (...) so coming to see emotions as a distinctive and irreducible class of mental states lying at the intersection of intentionality, phenomenology, and motivation. Affect theory, a growing approach to inquiry in the social sciences and humanities that appraises the historical and cultural contexts of emotions as expressed through art and politics, offers a frame for clinicians and researchers to consider ethical questions that surround the reopening of the United States economy in the wake of COVID-19. It is often claimed that the autonomy of heroin addicts is compromised when they are choosing between taking their drug of addiction and abstaining. This is the basis of claims that they are incompetent to give consent to be prescribed heroin. We reject these claims on a number of empirical and theoretical grounds. First we argue that addicts are likely to be sober, and thus capable of rational thought, when approaching researchers to participate in research. We reject behavioural evidence purported (...) to establish that addicts lack autonomy. We present an argument that extrinsic forces must be irresistible in order to make a choice non-autonomous. We argue that heroin does not present such an irresistible force. We make a case that drug-oriented desires are strong regular appetitive desires, which do not compromise consent. Finally we argue that an addict’s apparent desire to engage in a harmful act cannot be construed as evidence of irrational or compulsive thought. On these arguments, a sober heroin addict must be considered competent, autonomous and capable of giving consent. More generally, any argument against legalisation of drugs or supporting infringement of the liberty of those desiring to take drugs of addiction must be based on considerations of harm and paternalism, and not on false claims that addicts lack freedom of the will. The framework, Technological Pedagogical Content Knowledge, Ethics and Accomplishment (TPACKEA) provides an extension to a modified TPACK framework by adding ‘Ethics’ and ‘Accomplishment’. The reason is that further theoretical formulations and deployments need to be carried out on Technological Pedagogical Content Knowledge (TPACK) if TPACK research is to harmonize and constructively strengthen the field of blended/full online learning in higher education. It is a qualitative study that employed in-depth interviews for data collection. The data collection procedure of this study employed (...) a judgmental sampling of twenty (20) lecturers who used Sakai/MOODLE Learning Management System (LMS) for teaching. It was observed that the extension of the modified TPACK framework to include ‘Ethics’ and ‘Accomplishment’ needs was in practical terms suitable and necessary for effective teaching and learning in higher education. It has been recommended that universities provide education on academic ethics and appropriate behaviours, sponsor lecturers in their academic careers and create an enabling environment for teaching and learning so that lecturers will get to the state of accomplishment in a blended learning milieu. Is political equality viable given the unequal private property holdings characteristic of a capitalist economy? This book places the wealth-politics nexus at the centre of scholarly analysis. Traditional theories of democracy and property have often ignored the ways in which the rich attempt to convert their wealth into political power, operating on the implicit assumption that politics is isolated from economic forces. Part I analyses wealth and politics from the perspective of various political traditions, such as liberalism, republicanism, anarchism, and Marxism. The ways in which Wittgenstein was directly influenced by William James (by his early psychological work as well his later philosophy) have been thoroughly explored and charted by Russell B. Goodman. In particular, Goodman has drawn attention to the pragmatist resonances of the Wittgensteinian notion of hinge propositions as developedand articulated in the posthumously edited and published work, On Certainty. This paper attempts to extend Goodman’s observation, moving beyond his focus on James (specifically, James’s Pragmatism) as his pragmatist reference point. (...) It aims to articulate the affinity between Wittgenstein’s thought on the topic of certainty and that of the neglected pragmatist thinker, George Santayana. -/- The paper draws on Duncan Pritchard’s recent reading of Wittgenstein’s On Certainty in order to articulate the concept of certainty involved in the notion of hinge propositions. It identifies two important and related points of affinity between this Wittgensteinian line of thought on certainty and the line of thought on the same topic articulated in Santayana’s Scepticism and Animal Faith. The paper argues, firstly, that, both lines of thought reflect a pragmatist concept of certainty, according to which our most fundamental certainties are not conceived as purely theoretical objects of belief or knowledge but rather as thearational presuppositions of beliefs and practical action. Secondly, it examines the way inwhich the pragmatist concept of certainty functions, for the two thinkers as a response to scepticism. It argues that although the two thinkers’ responses are very different, they are mutually compatible and, together, point towards the possibility of a distinctively pragmatist response to scepticism, which involves an anti-epistemological model of the intimate relation of the human self to the world.
